China has proposed draft Measures for regulating generative AI, which include both the research and development of products with AI functions.
Companies providing generative AI services through APIs are to be held responsible for all content produced. However, it remains unclear whether the term "public" refers to Chinese consumers, and whether non-Chinese providers will be subject to the rules. Notable requirements include the need for a security assessment and filing of algorithmic details with the Cyberspace Administration of China (CAC) before offering services, the responsibility of providers for content produced, filtering of inappropriate content, and proper handling of personal information.
China's regulatory approach has been vertical and iterative, targeting specific AI applications with precision. The draft builds on earlier regulations for recommendation algorithms and "deep synthesis" but better targets text-based AI applications due to the rise of chatbots like ChatGPT. The CAC's regulatory toolkit includes an algorithm filing system for conducting security assessments and algorithmic disclosures. China's approach offers lessons for other governments as they navigate AI regulation.
